Two documents, not one##

Your licence to install and run the Unplayed app is Apple’s Standard End User License Agreement, which applies automatically to apps downloaded from the App Store. You can read it at Apple’s Standard End User License Agreement.

This page is a different thing. It is Unplayed’s own Terms of Service, and it covers what the standard agreement does not: what the app sets out to do, what it depends on, and what happens when those dependencies fail.

Where the two conflict on the subject of the app licence itself, Apple’s agreement governs.

What Unplayed is##

Unplayed is a listen-later app. It keeps a list of music releases you intend to hear and hands you off to the service that actually plays them.

Unplayed does not host, stream, or sell music. It holds no rights to any recording, cover artwork, or artist name shown in the app. It is an index and a hand-off, and nothing more.

Third-party content and services##

Nearly everything Unplayed displays comes from somewhere else: Apple Music, Spotify, TIDAL, Deezer, YouTube Music, Odesli, and Douban. That has consequences worth knowing before you rely on the app.

None of this is under our control, and we cannot promise it will keep working.

Pro##

Some features require Pro, an in-app purchase offered as a monthly subscription, an annual subscription, or a one-time lifetime purchase. Current prices and what each includes are shown in the app before you buy.

The free tier##

Without Pro, Unplayed holds up to 10 releases in total, counting your Library and your Played list together. Reaching that limit stops you adding more. It never deletes, hides, or degrades anything you have already saved.

Acceptable use##

Do not use Unplayed to break the law, to violate a streaming platform’s terms, or to interfere with the app or the services it depends on. Do not attempt to circumvent the free tier’s limit or the Pro purchase.

No warranty##

Unplayed is provided as is. It is made by one person. It may contain defects, it may lose data, and it may stop working when something it depends on changes. We do not warrant that it will be available, accurate, uninterrupted, or fit for any particular purpose.

Keep your own record of anything you cannot afford to lose.

Limitation of liability##

To the fullest extent the law allows, the developer is not liable for any indirect, incidental, or consequential loss arising from your use of Unplayed — including lost data, lost time, or a release you meant to hear and did not.

Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim.

Nothing here limits rights you hold under consumer protection law that cannot be waived.

Ending it##

You may stop using Unplayed at any time by deleting it. We may stop distributing or supporting the app at any time; if we do, the copy already on your device keeps working for as long as it can, though nothing depending on an outside service is guaranteed.

Governing law##

These terms are governed by the laws of the Hong Kong Special Administrative Region, and any dispute is subject to the exclusive jurisdiction of the Hong Kong courts.

Changes##

If these terms change, the date at the top changes with them. Continuing to use the app after a change means you accept it.
